Legal
Terms and Conditions
These Terms are an agreement between you and Songcase ("Songcase", "we", "us") and govern your use of songcase.app and any Songcase membership you buy. They also cover the Mac app Lucid Lab and Lucid Lab Pro, made by Lucid Labs, for the people using them. By making a Songcase account, downloading Lucid Lab or buying a subscription you agree to them.
Who you are buying from
Songcase memberships are sold through our online reseller Creem (creem.io), the Merchant of Record for those orders. Lucid Lab orders are conducted by our online reseller Paddle.com, the Merchant of Record for those. Your payment, receipt, any VAT or sales tax and refunds are handled by that reseller under its buyer terms; the service, the software and its licence come from us.
Who can use Songcase
You must be at least 13 years old to make a Songcase account or a Lucid Lab account. If you are under 18, or under the age of majority where you live, you may use them only with the permission of a parent or legal guardian, who agrees to these terms for you and is responsible for your use, including any purchase. If we learn that an account belongs to someone under 13, we close it and delete what it holds.
Services we connect to
Some features use other companies' services, and their terms apply when you use them through Songcase: linking YouTube in Grow uses the YouTube API Services, and by doing so you agree to the YouTube Terms of Service; linking Dropbox or Google Drive is under their terms; payments are Creem's or Paddle's (above).
Songcase plans
A Songcase account is free: a page, 10 songs with up to 500 MB of song files and 3 private links a calendar month, with 3 lyric sheets, 3 notes, one release plan and one theme. On the free plan songs are kept as MP3 (a WAV, AIFF or FLAC you add is made into a 320 kbps MP3 in your browser before it is uploaded), each file is at most 50 MB, and a private link stays open at most 14 days and plays at most 100 times. Project backups are not part of the free plan. A Songcase membership ($14.99 a month or $99 a year) gives 100 GB for your songs, their stems and your project backups together, private links without a limit, letters to fans, quotes, split sheets signed by link and linked Dropbox or Google Drive, and renews like any subscription here until you cancel; you can ask for a full refund within 14 days of the first payment. Songs (masters, versions and stems, which must be audio files) and backups (project snapshots) are both counted; a file used by both counts once. The space is one pool per account. Over a limit on the free plan, only adding stops: what you stored stays, and you can still play, download and share it. When a membership ends, your 10 most recently changed songs stay on the free plan and the other songs kept in Songcase are deleted 30 days later; we email you when it ends, a week before and the day before, and if you join again before then nothing is deleted. You can download them at any time before. Songs kept in your own Dropbox or Google Drive are never touched. The member features stop until you join again. With a paid plan each file is at most 2 GB.
Subscriptions
Paid plans are billed monthly or yearly in advance and renew automatically until you cancel. You can cancel at any time in your billing portal; the plan then stays active until the end of the period you have paid for. If a payment fails, the plan stays active for seven days while you update your card. We may change prices for future billing periods; we will tell you before a change applies to you, and you can cancel before it does.
Your work
Your songs, projects, audio and everything you make stay yours. Keep your own copies too: you are responsible for your projects and files. Upload, share and put on your page only what you have the right to: your own work, or work you have permission to use. You give us only the permission we need to store, play and show it as you choose. Songcase is for music and the work around it: it is not a place to keep or hand out other files.
Quotes you send from a Songcase page, and their terms, are between you and your client: we are not a party to them, we don't hold or pass on any payment, and we don't settle disputes. We keep the record of an agreement (who agreed, when, and what) and send it to you both. Write your own terms, and have them checked if they matter to you.
Copyright complaints
If you believe something on Songcase uses your work without permission, email our copyright agent at support@songcase.app with the subject "Copyright complaint", and include: the work you own; the link to what you believe infringes it; your name, address, phone number and email; a statement that you believe in good faith the use isn't authorised by you, your agent or the law; a statement that the information is accurate and, under penalty of perjury, that you are the owner or authorised to act for them; and your signature (a typed name is enough). We remove or disable what is reported and tell the person who uploaded it. If you think your work was removed by mistake, you can send us a counter-notice with the same details, a statement under penalty of perjury that it was removed by mistake, and your consent to the jurisdiction of the courts where you live (or, outside the US, of any court where we can be found); we may then restore it after 10 to 14 business days unless the complainant tells us they have gone to court. We close the accounts of people who infringe again and again.
Warranty and liability
Songcase and Lucid Lab are provided "as is". We work hard to make them reliable but do not promise that they are free of errors or that they suit every purpose. To the extent the law allows, we are not liable for indirect or consequential loss, or for lost data, work or profits, and our total liability is limited to what you paid us in the twelve months before the claim. Nothing here limits rights you have by law as a consumer.
Ending
You can stop using Songcase or Lucid Lab at any time, and delete your account on your account page or in the iPhone app. We may end an account or a licence that is used against these terms. Sections on liability and your work survive.
Changes and contact
We may update these terms; the date above changes when we do, and material changes are announced before they apply. Questions: support@songcase.app.
Lucid Lab, our Mac app
Lucid Lab isn't offered right now. For the people using it:
The licence
We grant you a personal, non-exclusive, non-transferable licence to use Lucid Lab on Macs you own or control while your Lucid Lab Pro subscription or trial is active; one subscription covers up to two Macs at a time. You may not resell, sublicense, share your licence key publicly, or try to get around the licence checks. The software is licensed, not sold; we keep all rights in it.
The trial
Lucid Lab Pro starts with a 14-day free trial, which needs a payment method. If you do not cancel before the trial ends, your subscription starts and the first payment is taken; if you cancel, you are not charged and Lucid Lab then shows only the page to subscribe. It renews and ends like any subscription above.
Your projects
Lucid Lab works on your Mac; changes to a project are shown to you and applied only when you confirm them.
